Please read the following terms and conditions carefully, they apply to all website design services offered by Time for Design. The acceptance of a commission shall be deemed as a contractual agreement between the client and Time for Design, this online formation is governed by UK law, if requested a written copy of the contract will also be posted to the client.

We reserve the right to refuse to construct a website which we may judge as unfit due to its content. This includes, but is not limited by, sites containing adult orientated material such as pornography, sites which promote hatred towards persons belonging to any ethnic group, religion or sexual orientation and sites which infringe copyright or are contrary to UK laws

        Quotation 

Time for Design will provide the website and features as described in their quotations.

All quotations are valid for 30 days. Time for Design reserves the right to withdraw quotations, in writing, within the 30 day period, unless a deposit has been paid by the client. Time for Design requires a 50% non-refundable deposit, based on the agreed and accepted quotation.

        Commissions

Time for Design makes every effort to design pages which display and perform effectively in the most popular current browsers, but cannot accept responsibility for pages which do not display acceptably in new versions of browsers released after the pages have been designed. All websites will be built at a fixed width for optimal viewing in 800 x 600 resolutions. In addition to any images supplied by the client, Time for Design may use additional images from an image and clip art library, which freely allows images to be used on websites created for clients by Time for Design. If, during the website construction process, the client does not supply the content required in order to complete the commission during the timescale agreed, Time for Design will assume that the client wishes to cancel the commission. Time for design will contact the client to confirm the cancellation; any deposit paid is not refundable. Time for Design reserve the right to maintain a visible hyperlink on each website it creates in part or whole, linking directly to the Time for Design website homepage. This link is not to be removed or modified in any way without the express written permission of Time for Design.

        Draft Designs    

An initial draft design for a website may be provided for the client at the discretion of Time for Design. Draft designs are entirely the copyright of Time for Design until fully purchased by the client. Time for Design reserves the right to use any draft designs in any marketing material representing Time for Design. Time for Design reserves the right to amend a draft design, including substituting images with suitable alternatives in the final design. During the design process, Time for Design will place the client’s website on a demonstration server in order that the client may view and comment upon the websites progress. On agreement that the website contains the correct information and meets the agreed criteria, Time for Design will invoice the client for the full balance payable. On receipt of payment, Time for Design will upload and publish the finished website.

        Hosting and Servers

Time for Design reserves the right to sub-contract hosting services and may change this sub-contractor without giving notice to the client. Time for Design does not guarantee continuous service and will accept no liability for loss of service, whatever the cause.

Time for Design may change the type of hosting account used for customers whose site uses an unusually high level of bandwidth. Bandwidth in excess of 2GB per month will be subject to additional charges. Subsequent annual hosting charges will apply on all clients’ websites. Time for Design will use all reasonable efforts to make available to you at all times, the server and services, but we shall not, in any event, be liable for interruptions of service or downtime of the servers.

        Payment   

A 50% deposit will be paid by the client to Time for Design, based on the fees likely to be incurred as presented in the quote, before Time for Design starts work on the client’s commission, excluding any initial draft design. Any additional features to the original and accepted quotation are subject to an additional charge. An invoice for 50% of the costs of these additional features will be issued with payment due within 5 working days. The remaining 50% will be added to the final invoice.

All final invoices for work and services completed for the client are due for payment within 30 working days of the date of the invoice. Time for Design reserves the right to withhold or remove a website or any work Time for Design creates for a client from publication or submission prior to full and complete payment.

Payment is accepted by cheque, bankers draft and online Pay pal Services. Payments by Pay pal services are subject to an additional 5% handling charge.

Late payments will be subject to interest charges on any monies owed at the rate of 3% interest per month, calculated weekly and compounded monthly. Failure to apply interest does not constitute a waiver of the option to charge.

For late payments, Time for Design reserves the right to withdraw all services, until the outstanding debt is settled. This may include, but is not limited to, removing any material stored on any server, preventing access to any and all documents, papers, material etc. belonging to the Client. Time for Design is not obliged to keep electronic or paper copies of any such material for more than 3 months from date they were supplied or created. Time for Design shall not be liable for any loss monetary or otherwise, as a result of taking any such actions.

The currency for all invoices and transactions will be in Great British Pound Sterling.

        Copyright

All material, both text and images which are supplied by the client to Time for Design, and is used in the construction of the clients’ website, will remain the clients’ property. It will be assumed that all such material is the property of the client and free to be used without fear of breach of any copyright laws. The client is responsible for ensuring that any such material is not protected by copyright.

The copyright of all material provided by Time for Design, such as text, graphics, photographs and html code, will remain the property of Time for Design, until full and complete payment has been made, whereupon they will become the property of the client. The client will then assume the full copyright ownership of the site, and all of the material contained within the website, including text, graphics, and html code. All data stored in any online database is the property of the client along with any rights and responsibilities and duties in relation to the Data Protection Act.

        Errors       

Any errors identified with work undertaken by Time for Design must be notified in writing on immediate discovery. Time for Design will attempt to resolve any genuine errors as quickly as possible. Time for Design cannot accept responsibility for any loss either monetary or otherwise due to any web site errors.

        Termination of Contract

Time for Design or the client has the right to terminate the contract. In either case, 2 months written notice must be given to the other party. The client will then assume the full copyright ownership of the site, and all of the material contained within the website, including text, graphics, and html code. All data stored in any online database is the property of the client along with any rights and responsibilities and duties in relation to the Data Protection Act.

        Disclaimer 

The client indemnifies Time for Design and shall keep Time for Design indemnified and hold Time for Design harmless from and against any and all breaches by the client of all items within the entire Time for Design terms and conditions and any claim brought against Time for Design by any third party in connection with or resulting from the provision of the services by Time for Design to the client including, but not limited to, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including all reasonable legal costs and expenses) howsoever suffered or incurred by us in consequence of the breach or non-observance of the terms and conditions. Time for Design reserves the right to withdraw any of our services in whole or in parts without prior notice. Time for Design shall be under no liability whatsoever to the client for any costs, losses and damages, howsoever arising, that the Client may incur or may have incurred, due to the removal of such services.

        Time for Design Website     

Time for Design takes all reasonable measures to ensure that the content of the Time for Design website is valid and correct. Time for Design cannot be held responsible for any decisions taken based on the content of the Time for Design website.

All content of this website (Time for Design) is the copyright of Time for Design and may not be reproduced in any way without express written permission from Time for Design. All copyrights and trademark notices, marks, disclaimers and other such elements must be preserved and upheld at all times. Time for Design does not accept any responsibility for the contents of materials viewable from this site. These materials may be provided by (but are not limited to) links, frames, portals or other websites.

        Privacy Policy     

Your privacy is very important to us and we are committed to letting you know how we use your personal information. Information which identifies you personally will be utilised only to provide the services you require and for providing you with information about our products and services. It will not be sold or disclosed to third parties without your permission unless we are required to do so by law.
